Fitness Champs Excellence Sports Academy — Swim Programme Terms

1) Definitions

Term / Cycle:
A block of 10 weeks (or as published), comprising scheduled weekly sessions.
Session/Class:
One scheduled lesson of the enrolled programme.
Programme Duration:
The published duration for your enrolled programme (see Section 4).
Make-up / Replacement Class:
A replacement session approved under Section 6.
Start Date:
The first scheduled session date for the student in the enrolled term.

2) Enrolment & Slot Confirmation

  • A student is only considered enrolled and a slot is only confirmed when full payment is successfully received and reflected in FCESA's system.
  • Unsuccessful/failed payments do not reserve slots. FCESA may release the slot without further notice.
  • Please check your selected programme duration and start date before payment; successful payment confirms your slot subject to facility and safety requirements.
  • FCESA may refuse, pause, or cancel enrolment if:
    • required information is incomplete;
    • eligibility criteria are not met; or
    • there are safety/behaviour concerns that present a risk to the student, other participants, staff, or facility.

3) Fees, Term Payment & Proration

3.1 10-week upfront payment

All standard swim programmes are billed 10 weeks upfront (one term/cycle), unless otherwise stated in writing.

3.2 Prorated fees

If the student's Start Date begins after the published term begins (or there are fewer than 10 remaining sessions available), fees will be prorated based on the remaining sessions from the Start Date to the end of the term/cycle.

Default proration formula:

Prorated Fee = (Full 10-week Term Fee ÷ 10) × Number of Remaining Sessions

Bank/processor charges (if any) may still apply and may be non-refundable where a refund is approved (see Section 7).

3.3 Price changes

Fees may be revised with prior notice. New fees apply at the next renewal/term unless otherwise stated.

3.4 Payment methods

Payment may be made only via credit card in the portal. You are responsible for completing payment correctly.

4) Programme Durations, Term Dates, Holidays & Attendance

4.1 Programme durations (by programme)

  • Toddlers Programme: 30 minutes per session.
  • Ladies Swimming Programme: 45 minutes per session.
  • Termly Children Programme: 45 minutes per session.
  • Mixed Adult Swimming Programme: 45 minutes per session.
  • Private / Individual Classes: Duration follows the selected category/package and will be stated on the programme page, invoice, or confirmation.

4.2 Holidays & scheduling

Unless FCESA states otherwise, lessons may run through public and school holidays within the published term dates.

4.3 Punctuality

Late arrivals may lead to reduced in-water time. For safety and class flow, coaches will not be able to extend the session.

5) Missed Classes & No-Show

  • Missed classes without approved make-up reasons (Section 6) are forfeited and not refundable.
  • If a student is asked to sit out due to visible illness symptoms or safety concerns, the session is generally treated as used unless a make-up is approved under Section 6.

6) Make-Up Classes (Medical, Travel & Approved Reasons)

Replacement classes may be permitted only when the notification + proof requirements below are met.

6.1 Eligible reasons (documentation required)

Replacement may be approved for:

  • Medical / Injury – Submission of an official medical certificate from a licensed clinic/hospital covering the class date.
  • Travel – Submission of verifiable travel documentation showing the student is away on the class date(s) (e.g., flight itinerary/booking confirmation, visa/entry, employer or school letter).
  • Exceptional circumstances – At FCESA's discretion with supporting evidence.

6.2 Non-eligible reasons (no make-up)

No make-ups for personal events, parties, playdates, scheduling conflicts, forgetting, minor ailments without MC, or choosing not to attend.

6.3 Notice & submission timeline

  • Notify FCESA before the class starts (or within 24 hours after in genuine emergencies).
  • Supporting documents must be submitted within 7 calendar days of the missed class. Late submissions may be rejected.

6.4 Limits, booking, and conditions

  • Make-ups are subject to availability, safety ratios, and class suitability.
  • Make-ups must be pre-booked and confirmed by FCESA (no walk-ins).
  • Make-ups may be offered at different day/time/venue/instructor from the original booking.
  • Make-ups must be used within the same term/cycle, unless FCESA issues with a stated expiry.
  • Make-ups will not be processed if there is an outstanding balance.

6.5 No-show for a confirmed make-up

A no-show for a confirmed make-up is forfeited and treated as used.

7) Cancellations, Refunds & Credits

7.1 Cancellation by FCESA

If FCESA cancels a class (e.g., coach illness, pool closure, facility repair, water quality, safety restrictions), FCESA will provide a make-up or another reasonable alternative.

7.2 Cancellation/withdrawal by you

No refunds for withdrawals/cancellations initiated by you after the term has commenced, except where mandated by law or explicitly approved by FCESA under Section 7.3.

7.3 Exceptional cases (discretionary)

In exceptional cases (e.g., long-term medical supported by MC; relocation out of country), FCESA may issue a credit note or approve a partial prorated refund at our discretion. Approved refunds may exclude administration and payment processing costs.

8) Coach Changes, Class Format & Progression

  • Coaches may change for operational reasons.
  • Student progression/level is determined by termly assessment.
  • Where a level change results in a different fee band, FCESA may apply a fair pro-rate approach for remaining sessions.

9) Health, Medical Fitness & Duty of Disclosure

  • You must disclose any medical conditions that may affect safe participation (e.g., asthma, epilepsy, heart conditions, allergies, behavioural concerns, learning needs).
  • Do not attend if the student is unwell (fever, contagious illness, vomiting/diarrhoea, open wounds).
  • You confirm the student is medically fit for aquatic activities and accept that swimming carries inherent risks (see Annex A).

10) Safety Rules, Facility Rules & Behaviour

10.1 Mandatory compliance with FCESA + Facility Management/Owners' rules

You and the student must follow all FCESA safety rules and coaching instructions at all times.

You and the student must also follow all rules, regulations, and instructions imposed by the facility management and/or owners (including lifeguards and venue staff). This includes (where applicable):

  • pool admission controls and capacity limits;
  • attire/shower/hygiene requirements;
  • lane allocation and pool movement rules;
  • spectator/waiting area restrictions;
  • photography/video restrictions;
  • emergency procedures and safety directives.

If facility management/owners require a rule change on short notice, FCESA will implement it immediately for safety and compliance.

10.2 Removal for safety / non-compliance

FCESA may refuse participation, remove a student from the pool, or suspend services if behaviour is unsafe or non-compliant. No refund is payable for removal due to non-compliance, misconduct, or safety risk.

10.3 Parent/guardian supervision

Parents/guardians are responsible for minors outside lesson time and in all non-coaching areas (changing rooms, showers, waiting areas), subject to venue rules.

10.4 Attending and Leaving the Facility

  • Children 10 years and over with consent from the parent or guardian are allowed to attend or leave the facility alone.
  • Children 8 and 9 years must attend and leave the facility with a parent or guardian, but the parent or guardian may leave the facility, informing the coach of their location during the session.
  • Children 7 years and under must always have a parent or guardian present within the facility.
  • Please ensure an FCESA coach is present at the venue before leaving your child.

10.5 Collection

All participants should be collected from the pool area.

10.6 Child Safeguarding

10.7 Dress code

Please send your child in appropriate clothing – Swimming costume, FCESA Swim Cap and goggles.

11) Photography, Video & Use of Images

  • No photography/video recording during lessons unless FCESA gives written permission.
  • FCESA may take photos/videos for coaching feedback and marketing. You consent unless you opt out in writing.
  • FCESA does not sell images to third parties and will handle them per applicable privacy requirements.

12) Liability, Exclusion & Indemnity (Summary)

  • Swimming/aquatic activities carry inherent risks.
  • To the maximum extent permitted by law, FCESA is not responsible for injury, loss, damage, illness, or death arising from participation except to the extent caused by FCESA's proven negligence where such liability cannot be excluded by law.
  • Annex A (Indemnity / Release & Waiver Form) forms part of these T&Cs and must be accepted/signed.

13) Personal Data & Communications

FCESA collects and uses personal data for enrolment, safeguarding, payments, scheduling, communications, and programme delivery, in accordance with FCESA's Privacy Notice.

14) Governing Law & Jurisdiction

These T&Cs are governed by the laws of Dubai/UAE and disputes will be subjected to the courts of Dubai/UAE, unless mandatory law provides otherwise.

15) Acceptance

By completing payment or attending sessions, you confirm acceptance of these T&Cs and Annex A.


Annex A

Indemnity / Release & Waiver Form

Fitness Champs Excellence Sports Academy ("FCESA") — Swim Programme Indemnity, Release & Assumption of Risk

A1) Assumption of Risk

  • I understand swimming and aquatic activities involve inherent risks (including slips, falls, cramps, fatigue, collisions, and drowning risk).
  • I voluntarily assume all risks associated with participation, including risks arising from acts/omissions of other participants.

A2) Fitness to Participate & Disclosure

  • I confirm the student/participant is medically fit to participate.
  • I have disclosed all relevant medical conditions, allergies, and special needs to FCESA.
  • I agree to update FCESA immediately if health conditions change.

A3) Compliance with Safety and Facility Rules

  • I agree the student/participant will follow all instructions from FCESA coaches/staff and facility lifeguards/management/owners.
  • I acknowledge that failure to comply may result in removal from class without refund.

A4) Release of Liability (Maximum extent permitted by law)

  • I release FCESA, its directors, officers, employees, coaches, and agents from claims arising from participation except to the extent caused by FCESA's proven negligence where such liability cannot be excluded by law.
  • I understand FCESA does not accept responsibility for loss/theft of personal belongings.

A5) Indemnity (Excluding FCESA's responsibility as far as legally allowed)

I agree to indemnify and hold harmless FCESA, its staff, and agents from claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • breach of these T&Cs or safety/facility rules by me, the student, or accompanying guests;
  • negligent or wrongful acts/omissions by me, the student, or accompanying guests;
  • non-disclosure or misrepresentation of medical/safety-relevant conditions;
  • damage caused by me, the student, or accompanying guests to the facility or third parties.

A6) Emergency Care Authorization

In an emergency, I authorize FCESA and/or venue staff to provide first aid and/or obtain medical assistance for the student/participant. I agree to bear associated costs.

A7) Acknowledgement & Signature

I have read and understood this Indemnity, Release & Waiver, and I accept it voluntarily.

By completing payment through the booking portal, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions and this Indemnity, Release & Waiver Form.
